1 Acceptance of Terms

These Terms of Service ("Terms") govern your use of SendNowly, operated by SendNowly ("we", "us", or "our"), a service based in the United States. By using the Service, you confirm you are at least 13 years of age and have the legal capacity to enter into this agreement.

2 Description of Service

SendNowly provides a file-sharing platform that allows users to upload files and share them via temporary links. The Service is offered in two tiers:

• Free Plan: Upload files up to 1GB, 3 files per day, links expire after 7 days, ad-supported.
• Pro Plan: Upload files up to 10GB, unlimited daily transfers, links expire after 30 days, no ads.

3 Prohibited Content

You may not use SendNowly to upload, share, or distribute:

• Illegal content of any kind under United States law or applicable local laws
• Child sexual abuse material (CSAM) or any content that exploits minors
• Malware, viruses, ransomware, or any malicious software
• Copyrighted material you do not have the right to distribute
• Content that promotes violence, terrorism, or hatred
• Spam or unsolicited bulk content
• Personal data of others without their consent

4 Your Content & Ownership

You retain full ownership of all files you upload. By using the Service, you grant SendNowly a limited, non-exclusive license to store and serve your files solely for the purpose of providing the Service.

You represent and warrant that you have all necessary rights to upload and share the content you submit through the Service.

5 File Retention & Deletion

Files are automatically and permanently deleted after their expiry period (7 days for free, 30 days for Pro). We are not responsible for any loss of data resulting from file expiry. It is your responsibility to save copies of important files before the expiry date.

6 Pro Subscriptions & Payments

• Pro subscriptions are billed monthly or annually as selected at checkout.
• Payments are processed securely through Stripe or PayPal.
• Subscriptions renew automatically unless cancelled before the renewal date.
• Refunds are available within 7 days of purchase if the service has not been substantially used.
• We reserve the right to change pricing with 30 days' notice to active subscribers.

7 Advertising

The free plan is supported by third-party advertising provided by Adsterra. By using the free plan, you consent to the display of advertisements. Pro subscribers do not see ads. We are not responsible for the content of third-party advertisements.

8 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice. We are not liable for any downtime or data loss resulting from outages.

9 Limitation of Liability

To the maximum extent permitted by law, SendNowly shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or damage to reputation.

10 Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the courts of the United States.

11 Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify Pro subscribers of material changes via email.
